TERMS OF SERVICE
Last Updated: August 26, 2026
We’ve lived long enough to know that sometimes the best advice comes wrapped in more “legalese” than any normal person would ever choose to read over a cup of coffee.
So while we’d much rather spend our time around the kitchen table, these Terms of Service explain the legal rules that apply when you visit Well Seasoned Chef, receive Letters from Saigon to Texas, become a member, use our website, or purchase a service from us.
Please read them carefully.
OVERVIEW
This website is operated by Well Seasoned Chef, including the Letters from Saigon to Texas letter and membership experience.
Throughout these Terms, the words “Well Seasoned Chef,” “we,” “us,” and “our” refer to the operator of this website and its related services.
The terms “you” and “your” refer to the person accessing or using the website or purchasing or receiving our services.
Well Seasoned Chef offers this website, including the information, stories, recipes, photographs, videos, member materials, physical mailed letters, tools, features, and services available through it, conditioned upon your acceptance of these Terms of Service.
By accessing or using any part of our website, creating an account, joining Letters from Saigon to Texas, or purchasing any service from us, you agree to be bound by these Terms of Service and by any additional policies referenced in them, including our Privacy Policy and any applicable Refund or Cancellation Policy.
If you do not agree with these Terms, you should not use the website or purchase our services.
We may add new features, materials, services, or tools to the website in the future. Unless otherwise stated, those additions will also be governed by these Terms.
SECTION 1 — ELIGIBILITY AND ACCEPTABLE USE
By using this website or purchasing our services, you represent that you are at least the age of majority in your state of residence or that you have the legal authority to enter into this agreement.
You may not use our website, membership, mailed materials, recipes, videos, downloads, or other services for any unlawful or unauthorized purpose.
You may not transmit viruses, worms, malware, destructive code, or anything intended to interfere with the operation or security of the website.
A material violation of these Terms may result in suspension or termination of access to our services.
SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse or discontinue service when reasonably necessary, including in cases involving fraud, abuse, violation of these Terms, attempted misuse of our content, or conduct that threatens the safety or operation of our website or community.
Information transmitted through the Internet may pass through multiple networks and systems.
Payment information is processed through third-party payment providers and is subject to the security practices and terms of those providers. We do not intentionally store complete credit-card numbers on our own website unless specifically disclosed.
You may not reproduce, duplicate, copy, sell, resell, commercially exploit, or redistribute any portion of our services or proprietary content without our prior written permission except where applicable law permits otherwise.
Section headings are provided for convenience and do not limit the meaning of these Terms.
SECTION 3 — LETTERS FROM SAIGON TO TEXAS
Letters from Saigon to Texas is a recurring service centered around physical mailed letters and related materials.
The contents of individual mailings may vary and may include letters, stories, recipe cards, keepsakes, printed materials, labels, bookmarks, photographs, quotations, or other items selected by Well Seasoned Chef.
Because this is a story-based experience, the content, format, design, packaging, and accompanying materials may evolve over time.
We do not guarantee that every monthly mailing will contain identical categories or quantities of materials.
Unless expressly stated otherwise, membership does not transfer ownership of our copyrighted stories, photographs, recipes, artwork, designs, videos, or other intellectual property.
SECTION 4 — MEMBERSHIP, BILLING AND RECURRING PAYMENTS
When you join a recurring monthly service, you authorize us and our payment processor to charge the payment method you provide at the price disclosed to you at the time of enrollment, plus any applicable taxes or charges that are clearly disclosed.
Recurring charges will continue until the membership is canceled in accordance with our cancellation procedures.
You are responsible for keeping your billing information current.
If a recurring payment is declined or cannot be processed, we may attempt to process the payment again, contact you for updated information, temporarily suspend member access, or pause future mailings until the account is brought current.
We will not intentionally increase the recurring rate applicable to an existing continuous membership where we have specifically promised that the member’s rate will remain fixed, except with the member’s express authorization or as otherwise required by law.
If a membership is canceled and later restarted, any prior promotional, introductory, Founding Reader, or grandfathered rate may no longer be available unless we expressly agree otherwise.
SECTION 5 — CANCELLATION
You may cancel a recurring membership in accordance with the cancellation method provided on our website or by contacting us using the contact information listed below.
Cancellation stops future recurring charges after the cancellation becomes effective.
Amounts already charged before a cancellation becomes effective are subject to our applicable refund policy.
Because physical letters and materials may be prepared, printed, packaged, or mailed in advance, cancellation may not always stop a mailing that has already entered production or been delivered to the postal system.
We will make reasonable efforts to process cancellation requests promptly.
SECTION 6 — MAILING ADDRESS AND DELIVERY
You are responsible for providing a complete and accurate mailing address.
If your address changes, you are responsible for updating it promptly.
We are not responsible for mail that is lost, delayed, returned, misdelivered, or damaged because an incorrect or outdated address was supplied.
Once an item has been transferred to the United States Postal Service or another carrier, actual delivery time and handling are outside our direct control.
Postal delays, weather events, carrier interruptions, holidays, natural disasters, and other circumstances may affect delivery schedules.
If a mailing is returned to us as undeliverable, we may contact you to confirm or correct your address before resending it. Additional postage or handling charges may apply when repeated delivery problems are caused by an incorrect address.
SECTION 7 — MODIFICATIONS TO SERVICES AND PRICES
Prices for future memberships, products, or services may change without affecting a price that we have specifically agreed to honor for an existing continuous membership.
We may modify, improve, replace, suspend, or discontinue features of the website or services.
When a material change affects an ongoing paid service, we will provide reasonable notice when practical.
We will not be liable for modifications or discontinuation of a service except to the extent required by applicable law or an express written refund policy.
SECTION 8 — PRODUCTS AND FUTURE OFFERINGS
At the present time, our primary paid offering is Letters from Saigon to Texas and its associated membership experience.
We may offer additional products, keepsakes, printed materials, or services in the future.
If physical products are offered, quantities may be limited, descriptions and photographs are intended to represent products as accurately as reasonably possible, and actual colors or appearance may vary because of printing, materials, lighting, screens, or production differences.
We reserve the right to limit quantities or discontinue future products or services.
Any offer made through this website is void where prohibited by law.
SECTION 9 — REFUNDS, RETURNS AND REPLACEMENTS
Refunds, returns, replacements, and credits are governed by the Refund or Cancellation Policy posted on our website at the time of purchase.
Because some materials may be personalized, prepared specifically for a mailing cycle, printed in limited quantities, or already placed into the postal system, certain purchases may not be refundable once processing has begun.
Nothing in these Terms limits any rights that cannot legally be waived under applicable law.
SECTION 10 — ACCOUNT INFORMATION AND ACCOUNT SECURITY
Certain areas of the website may require a member account or sign-in credentials.
You are responsible for maintaining the confidentiality of your password and account credentials and for activity conducted through your account.
You agree to provide accurate and current information and to update your email address, mailing address, billing information, and other account information when necessary.
Please notify us promptly if you believe your account has been accessed without authorization.
Membership access is intended for the member or household for whom the account was created unless we expressly provide otherwise.
You may not sell, transfer, publicly share, or commercially distribute member credentials or restricted member content.
SECTION 11 — RECIPES, COOKING AND FOOD INFORMATION
Recipes, cooking methods, gardening information, food-storage suggestions, reheating directions, photographs, videos, and other culinary information provided through Well Seasoned Chef are offered for general educational and informational purposes.
Cooking equipment, ingredients, food sizes, ovens, refrigerators, freezers, preparation methods, and individual circumstances vary.
You are responsible for using appropriate food-safety practices and determining whether ingredients and recipes are suitable for you and your household.
We cannot guarantee that any recipe or food-related material is free from allergens or cross-contact risks.
Individuals with allergies, food sensitivities, medical dietary restrictions, or other health concerns should independently review ingredients and, where appropriate, consult a qualified professional.
Well Seasoned Chef does not provide medical, nutritional, or healthcare advice.
SECTION 12 — INFORMATIONAL CONTENT
We make reasonable efforts to provide information that is useful and accurate, but we cannot guarantee that every item of information on the website will always be complete, current, or error-free.
Historical stories, family recollections, memories, photographs, and personal narratives may reflect the information available to us at the time they were created.
Some content is inherently personal, historical, or interpretive.
Information provided on the website should not be relied upon as the sole basis for legal, financial, medical, nutritional, gardening, safety, or other professional decisions.
SECTION 13 — INTELLECTUAL PROPERTY
Unless otherwise stated, the content made available through Well Seasoned Chef and Letters from Saigon to Texas is owned by or licensed to us and is protected by applicable copyright, trademark, and other intellectual-property laws.
This includes, without limitation:
- written stories and letters;
- recipes and original accompanying expression, photographs, notes, instructions, and layouts;
- photographs and videos;
- artwork and graphic designs;
- logos and branding;
- printable materials;
- member-only content;
- website text and design; and
- compilations and collections of materials.
You may use materials you lawfully receive for your own personal, noncommercial enjoyment.
You may not reproduce, publish, sell, distribute, upload, commercially exploit, or create unauthorized derivative commercial materials from our protected content without written permission.
Nothing in these Terms prevents you from engaging in uses that are permitted by applicable copyright law.
SECTION 14 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to services operated by third parties, including payment processors, email services, video platforms, social-media platforms, hosting providers, mailing services, or other technology providers.
Those services may operate under their own terms and privacy policies.
We do not control third-party services and cannot guarantee that they will always remain available, uninterrupted, or error-free.
Use of third-party tools is subject to the terms established by those providers.
SECTION 15 — THIRD-PARTY LINKS
Our website may contain links to third-party websites.
Those links are provided for convenience or informational purposes and do not necessarily constitute an endorsement.
We are not responsible for the content, privacy practices, products, services, security, availability, or accuracy of third-party websites.
Any transaction or interaction between you and a third party is between you and that third party.
SECTION 16 — COMMENTS, FEEDBACK AND SUBMISSIONS
If you voluntarily send us feedback, testimonials, suggestions, comments, photographs, stories, or other materials, you retain ownership of rights you already hold in your original material.
By intentionally providing material to us for publication, promotion, community sharing, or use in connection with Well Seasoned Chef, you grant us a nonexclusive, royalty-free license to use that material for the purpose for which it was submitted, unless we agree otherwise in writing.
We will not intentionally publish private correspondence as a testimonial or promotional statement without permission.
You may not submit material that infringes another person’s intellectual-property, privacy, publicity, or other legal rights.
We reserve the right to remove unlawful, abusive, defamatory, obscene, threatening, fraudulent, infringing, or otherwise inappropriate material.
SECTION 17 — PRIVACY
Our collection and use of personal information is governed by our separate Privacy Policy.
By using the website or services, you acknowledge that electronic communications and account information may be processed by third-party service providers that assist us in operating the website and delivering services.
SECTION 18 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally, the website or our communications may contain typographical errors, incorrect pricing, outdated descriptions, mailing information, availability information, or other inaccuracies.
We reserve the right to correct errors and update information.
If an error materially affects a purchase you have already made, we will handle the situation reasonably and in accordance with applicable law.
SECTION 19 — PROHIBITED USES
You may not use the website or our services:
for unlawful purposes;
to violate federal, state, local, or international laws;
to infringe intellectual-property rights;
to harass, threaten, abuse, defame, impersonate, or unlawfully discriminate against another person;
to submit intentionally false or misleading information;
to transmit malware or malicious code;
to collect personal information about others unlawfully;
to spam, scrape, crawl, probe, attack, or interfere with the website;
to bypass membership restrictions, security measures, payment requirements, or access controls;
to share restricted member materials in a manner that materially undermines the membership service; or
to engage in fraudulent or abusive activity.
We may suspend or terminate access for material violations of this section.
SECTION 20 — DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the website and services are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.
We do not guarantee that every postal mailing will arrive on a specific date or that third-party services will operate without interruption.
Except where expressly stated by us or required by law, we disclaim warranties to the fullest extent legally permitted.
SECTION 21 — LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Well Seasoned Chef and its owners, officers, employees, agents, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the website or services.
This includes, where legally permitted, losses arising from website interruptions, unavailable third-party services, postal delays, data loss, unauthorized account activity not caused by our failure to exercise reasonable care, or reliance upon informational content.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Where applicable law does not permit a particular limitation, that limitation will apply only to the maximum extent permitted by law.
SECTION 22 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Well Seasoned Chef and its owners, officers, employees, agents, contractors, service providers, and affiliates from claims, damages, obligations, losses, liabilities, costs, or expenses arising from your material violation of these Terms, violation of law, infringement of another person’s rights, or misuse of the website or services.
SECTION 23 — FORCE MAJEURE
We will not be responsible for delay or failure to perform caused by circumstances reasonably beyond our control, including natural disasters, severe weather, fire, flood, war, civil unrest, government action, public-health emergencies, power outages, Internet failures, postal disruptions, transportation interruptions, labor disputes, supplier shortages, equipment failures, or failures of third-party service providers.
We will make reasonable efforts to resume affected services when practical.
SECTION 24 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions will continue in full force and effect.
SECTION 25 — TERMINATION
These Terms remain effective while you use the website or services.
You may stop using the website at any time and may cancel paid services according to the applicable cancellation procedure.
We may suspend or terminate access when reasonably necessary because of fraud, nonpayment, abuse, violation of these Terms, security concerns, or unlawful activity.
Provisions that by their nature should survive termination—including intellectual-property rights, payment obligations already incurred, disclaimers, limitations of liability, indemnification, and governing-law provisions—will survive termination.
SECTION 26 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund or Cancellation Policy, and any other policies expressly incorporated by reference, constitute the agreement governing your use of the website and services.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
SECTION 27 — GOVERNING LAW
These Terms and any separate agreements through which we provide services will be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any additional dispute-resolution, venue, mediation, arbitration, or class-action provisions should be stated separately and clearly if adopted.
SECTION 28 — CHANGES TO THESE TERMS
We may update these Terms from time to time.
The current version will be posted on this page with an updated revision date.
For changes that materially affect an ongoing paid membership, we will provide additional notice when required by law or when we determine that additional notice is appropriate.
Your continued use of the website after updated Terms become effective constitutes acceptance of those updated Terms to the extent permitted by law.
